Welcome to PitchRight. These Terms of Service ("Terms") govern your access to and use of our AI-driven sales strategy platform. By using PitchRight, you agree to these Terms. If you do not agree, please do not use our services.

1. The Service & AI Nature

• AI-Generated Content: You acknowledge that the Persona, Client Status, and Action Item reports are generated by artificial intelligence.
• No Guarantee of Accuracy: While we aim for high-quality strategy, AI can produce "hallucinations" or incorrect outputs. You are responsible for verifying all AI-generated advice before acting on it in a professional sales capacity.
• Modifications: We reserve the right to modify or discontinue any feature (such as specific report loops) to manage API costs or improve performance.

2. User Accounts & Authentication

• LinkedIn SSO: Access requires "Sign in with LinkedIn". You are responsible for maintaining the security of your LinkedIn credentials.
• Professional Use Only: This service is intended strictly for professional B2B sales use. You must be at least 18 years of age to use the platform.

3. Usage & Billing (The "Fair Use" Policy)

• Pricing Tiers: Access is granted based on your selected tier (Starter, Pro, or Enterprise).
• Consumption Limits: Each tier includes a specific number of "Account Blueprints" (Report Runs). We reserve the right to throttle or block access if your usage patterns suggest automated botting or exceed your tier limits.
• No Refunds: Due to the high variable compute costs (COGS) incurred at the moment of report generation, we generally do not offer refunds for "used" report credits.

4. Data Ownership & Intellectual Property

• Your Input Data: You retain all ownership rights to the transcripts and notes you upload.
• Output Rights: PitchRight grants you a non-exclusive, royalty-free license to use the generated reports for your internal business and sales purposes.
• Our Technology: All software, agent architectures, and frameworks (the 26-layer persona model) remain the exclusive property of PitchRight.

5. Prohibited Conduct

You agree not to:

• Reverse Engineer: Attempt to extract the system prompts or agent logic used in our multi-agent workflow.
• Scrape the Scraper: Attempt to bypass our Scrapin integration to extract LinkedIn data in bulk.
• Input Sensitive Data: Upload passwords, highly classified government data, or financial credentials.

6. Disclaimer of Warranties

PitchRight is provided "as is" and "as available". We do not warrant that the AI-generated strategies will result in closed deals, increased revenue, or error-free client interactions.

7. Limitation of Liability

To the maximum extent permitted by law, PitchRight (and its developers) shall not be liable for any indirect, incidental, or consequential damages—including lost profits or failed sales cycles—resulting from your reliance on AI-generated content.

8. Termination

We may suspend or terminate your access immediately, without prior notice, if you breach these Terms or if your usage puts an undue burden on our API infrastructure.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Noida/Delhi.
